Chinese courts will give priority to WTO rules
BEIJING: If China enters the World Trade Organization, its civil courts will
give precedence to rules set by the global trade body, a Chinese supreme
court justice said Sunday, according to the government news agency.
"If WTO rules are not consistent with Chinese domestic laws, WTO rules have
the priority" in cases involving foreign litigants, Li Guoguang was quoted
as saying by the Xinhua News Agency.
The comments were apparently addressed at concerns that China's fledgling
legal system may not be up to the task of handling lawsuits by foreign
companies that run into difficulty when Chinas opens its markets upon
joining WTO.
Concerns have also been raised about the independence of China's courts and
the transparency of its legal process. (AP)
