Subject: CUBAN 5 WILL GET NEW TRIAL

FULL DOCUMENT OF COURT DECISION:

This brings the wonderful news that the 11th Circuit Court
of Appeals in Atlanta has ruled that the Cuban 5 will get a
new trial! Obviously there was no way that the judges could
ignore the overwhelming evidence that the Cuban 5 did not
receive a fair trial. And certainly this means that the
trial will not take place in Miami because clearly the
venue was the main obstacle for justice. The hard work of
all those who have supported the Cuban 5 throughout this
long ordeal, nationally and internationally, clearly helped
keep this case from being obscured and quietly doomed.

The legal teams from the lawyers at the trial itself (who
did a good job but were ignored in Miami) to the many
lawyers and others who helped with the appeal along with
the lead attorney, Leonard Weinglass, deserve special
recognition. International condemnation of the trial
climaxed recently with the undoubtedly influential
conclusion of the U.N. Working Group on Arbitrary
Detentions of the Human Rights Commission.

At the heart of this victory is the steady campaign waged
by the Cuban Government and the Cuban people to free these
five heros who were uncovering terrorist plots against Cuba
in Miami, the city that harbors terrorists even as the U.S.
Government wages a War of Terror that President Bush calls
a "War on Terror." The five heros themselves have provided
constant courage and inspiration for all of us.

Siempre,
Jane Franklin
